If you are finding it difficult to recover monies owed to you, Areddot Legal will assist by means of correspondence, telephone calls and if required, instigating court action. Court fees vary according to the debt you are trying to recover, starting at £30.00 for an amount up to £300.00.
If your claim is successful, and you are awarded judgment by the court, the defendant still may refuse to pay up. You can try to enforce judgment through the court by means of 1) a Warrant (or Writ) of Execution, which is effective if the defendant has assets which can be taken. In this case the courts will send bailiffs to collect the money you are owed. 2) if the defendant's bank account is in credit, consider using a Third Party Debt Order, whereby the bank is ordered to put aside the amount of your claim from funds in the defendant's account. 3) If the defendant is employed, his employer could be ordered, through an Attachment of Earning Order, to deduct the amount from the defendant's wages and pay it to you. 4) A Charging Order prevents the defendant (in the case of the defendant being an individual as opposed to a limited company) from selling the assets which you charge without paying the money you are owed. |
